Overview
Robert Gilmore is a trial lawyer who represents clients in high-stakes disputes: from leading companies such as Bechtel Corporation, Blue Cross Blue Shield insurers, and the big three recording labels Universal, Sony, and Warner, to high-profile individuals such as the actor Johnny Depp and the chef and humanitarian José Andrés. Mr. Gilmore specializes in complex lawsuits and arbitrations spanning a wide range of industries, most notably in healthcare/life sciences, media and entertainment, banking/finance, construction, and insurance. He has represented clients in important cases at trial and on appeal, including before the United States Supreme Court. In addition, he has helped negotiate celebrities’ contracts with news organizations and media outlets. Mr. Gilmore also has maintained an active pro bono practice, representing clients in suits under the Americans with Disabilities Act, family law proceedings, and in nonprofit counseling. He has received numerous awards and honors, including being named a BTI Client Service MVP and a SuperLawyers Rising Star multiple times, and receiving the Outstanding Pro Bono Service Award from the Washington Lawyers’ Committee on Civil Rights.
Mr. Gilmore is a member of the management committee at Stein Mitchell. He lives in Washington Grove, Maryland (where he previously held elected public office as Town Councilor), with his wife Emily Cavey (a professional photographer), and their four children.

Recent Representative Results
- Patrick K. Donnelly v. ProPharma Group (District of Delaware): Trial counsel for pharmaceutical consulting services company in breach of contract suit brought by a former board member, seeking several million in claimed compensation. After a four-day jury trial, secured a complete defense verdict.
- UMG Recordings, Inc., et al. v. Grande Communications Networks, LLC (Western District of Texas): Trial counsel for leading music recording companies in large-scale copyright infringement suit against an internet service provider. After a month-long trial, won a $46.8 million willful infringement jury verdict for the recording companies. Earlier in the case, obtained summary judgment against the ISP’s safe harbor defense under the Digital Millennium Copyright Act, a ruling cited in numerous copyright cases and authorities.
- Mainsail Parent, LLC (d/b/a Aspirion), et al. v. David Jewell, et al. (Southern District of Florida): Trial counsel for healthcare revenue cycle management company in suit against former employees for breach of nonsolicitation and confidentiality contract obligations and trade secrets theft. Secured temporary restraining order and then preliminary injunction after multi-day bench trial.
- Cano Health, Inc. v. Marlow B. Hernandez, et al. (Miami-Dade County, Florida Circuit Court, Complex Business Litigation Division): Trial counsel for publicly-traded healthcare provider in breach of contract suit against its former CEO and other executives for breaching their noncompete, nonsolicit, and confidentiality obligations. Secured injunction against defendants after two-day bench trial.
- Commercial Arbitration Matter: Trial counsel for leading health insurer in drug overpricing breach of contract dispute against a leading retail pharmacy chain. After a three-year arbitration involving two separate evidentiary hearings, obtained a $642 million award for our client.
- Commercial Arbitration Matter: Trial counsel for leading engineering, procurement and construction contractor in a large commercial arbitration brought by a leading power company, involving claims of over $1 billion. Obtained complete defense award in client’s favor after a two-year arbitration involving a 19-day evidentiary hearing.
- John C. Depp II, et al. v. Bloom Hergott (Los Angeles County Superior Court): Counsel for the actor Johnny Depp in legal malpractice and breach of fiduciary duty suit against his former entertainment lawyers. Obtained judgment on the pleadings in Mr. Depp’s favor on defendants’ counterclaims and secured an eight-figure settlement for Mr. Depp.
- Jose Andres Hotel Development, LLC v. Sunworld Dynasty US Holdings LLC (Los Angeles County Superior Court): Counsel for acclaimed chef and philanthropist José Andrés’ company in a dispute with the owners of the SLS Beverly Hills Hotel concerning Mr. Andrés’ Michelin-starred restaurant Somni and Bazaar by José Andrés. Secured a favorable monetary settlement for client.
- Commercial Arbitration Matter: Trial counsel for medical device company in breach of contract arbitration with former executive. Obtained complete defense award in client’s favor after 3-day hearing.
- Commercial Arbitration Matter: Counsel for leading financial technology venture capital firm, in a breach of contract and trade secret dispute with its former chief executive officer. After obtaining favorable rulings on initial dispositive motions and evidence preservation forensic discovery of our opponent, secured settlement on highly favorable terms: our opponent had initiated arbitration seeking more than $22 million, but ended up agreeing to pay our client $1 million.
