Stein Mitchell secures $8 million judgment for Aspirion

We are very pleased to announce that on Friday, February 7, 2025, the United States District Court for the Southern District of Florida entered an $8 million stipulated judgment in favor of our client Aspirion, a portfolio company of Linden Capital Partners, as part of a settlement resolving its noncompete/nonsolicit/trade secret theft case against a number of its former employees (David Jewell, Michael Cameron, Alisha Mays, and Megan Kelly) and the competing company those employees secretly formed while still employed at Aspirion (Ternium LLC). 

In July 2024, we filed a complaint and motion for TRO/preliminary injunction on behalf of Aspirion. The court held a multi-day evidentiary hearing in August 2024, at the conclusion of which it granted Aspirion a preliminary injunction against the Jewell and Cameron (the CEO and Chief Revenue Officer of Ternium), preventing them from soliciting or providing services to Aspirion’s customers. We then litigated the damages case against the defendants, defeating their motion to dismiss and successfully compelling forensic examinations of the defendants’ computers and devices, as well as production of damning internal emails and text messages. After a devastating deposition of Jewell, the CEO of Ternium, the defendants sought to settle. Under the parties’ settlement agreement, the defendants are paying Aspirion $8 million through a stipulated judgment enforceable by the court. The defendants also agreed to return / destroy all of Aspirion’s documents and data they had taken and had not returned when they left the company.
