Stein Mitchell Wins Appeal Against CVS in Prescription Drug Overcharge Class Action
On June 12, 2019, Stein Mitchell, along with co-counsel Hausfeld and Pritzker Levine, won a significant appellate victory against CVS on behalf of a class of prescription drug customers. The Ninth Circuit unanimously reversed the district court’s (1) grant of summary judgment in CVS’s favor, (2) narrowing of plaintiffs’ certified classes, and (3) exclusion of plaintiffs’ damages expert, meaning the case is now positioned for a class action trial. Stein Mitchell will continue fighting for the millions of customers CVS overcharged for their prescriptions, until CVS makes them whole.
