Stein Mitchell wins complete defense verdict for ProPharma against former board member Patrick K. Donnelly

On April 27, 2023, Stein Mitchell secured a complete defense verdict for ProPharma Group Holdings Topco, LLC, a former portfolio company of firm client Linden Capital Partners, in a breach of contract case brought by Patrick K. Donnelly, a former member of ProPharma’s board. Donnelly originally filed suit in November 2020, in the United States District Court for the District of South Carolina, seeking over $1.5 million in damages plus attorneys’ fees. Stein Mitchell successfully moved to transfer the case to the District of Delaware. After discovery, we obtained summary judgment against Donnelly’s non-contractual claims. Following a four-day jury trial, we obtained partial judgment as a matter of law. The jury then deliberated for less than an hour before rendering a verdict in ProPharma’s favor.
