Stein Mitchell Secures Victory for The South Beach Diet

Stein Mitchell partner Robert B. Gilmore successfully obtained a full dismissal of all claims against the owner of The South Beach Diet business, SBD Holdings Group Corp.  The lawsuit was brought by the former advisor to the business’ prior owner/founder, Etkin & Company, Inc. (“ECI”).  ECI, represented by Gibson, Dunn & Crutcher and Arnstein & Lehr, filed a breach of contract suit against The South Beach Diet business entities and its founders in 2011, seeking money damages and rescission of the transaction through which SBD Holdings acquired The South Beach Diet business.  After multiple rounds of motions practice, and following the close of discovery, the federal district court for the Southern District of Florida found for SBD Holdings on all counts, and dismissed it from the case.
